	<p>The route will fall under the sponsor licence system. It will enable overseas businesses to send workers to the UK to establish and expand the businesses.</p>
<p><strong>It has been indicated that the new route will have five sub-categories:</strong></p>
<ol>
<li>Senior or specialist worker to meet specific business needs;</li>
<li>Graduate trainee as part of a training programme;</li>
<li>UK expansion worker to establish a UK presence (this may allow up to five workers to<br />
be transferred to the UK if the MAC’s recommendations are followed);</li>
<li>Secondment employee (although if the MAC’s recommendation of a £50 million<br />
threshold are followed, this may mean that no more than a ‘handful’ of applicants can<br />
use it); and</li>
<li>Service supplier (in line with UK trade agreements). The Home Office has indicated<br />
that applicants will require sponsorship in all cases, although final confirmation of this<br />
is still needed.</li>
</ol>
<p>To qualify for the route, applicants will need the following requirements:</p>
<ul>
<li>in certain cases (likely to be the first two sub-categories above) sponsorship by the UK<br />
entity receiving the applicant</li>
<li>a minimum skill level for the role</li>
<li>a salary threshold</li>
<li>a minimum period of employment overseas</li>
<li>be on a temporary assignment to the UK</li>
</ul>
<p><em><strong>Please note:</strong></em> It is not yet clear if there will be an English Language requirement or whether this route will lead to settlement.</p>
<p><strong>High Potential Individual Route:</strong></p>
<p>The High Potential Individual route is aimed at attracting the highest international talent to the UK. The route will allow eligible individuals to come to the UK without needing a job offer and it is not expected that this route will require sponsorship. It is also expected that individuals approved under this route will be able to be employed or self-employed and will be able to switch jobs or employers without having to inform the Home Office. It is also anticipated that this route will lead to settlement in the UK.</p>
<p>Please note: There is little detail so far on the eligibility criteria, other than the applicant will need to have graduated from a ‘top global university’. It is assumed that the government will use specific league tables for global universities to determine which graduates qualify.</p>
<p><strong>Scale-Up Route:</strong></p>
<p>The Scale-Up route is intended to support the growth of UK businesses by allowing talented individuals with a high skilled job offer from a ‘qualifying scale-up’ to come to the UK.</p>
<p>The route will allow eligible individuals to work, switch jobs or employers, extend their visa and settle in the UK, subject to meeting the specific requirements.</p>
<p>Business that are regarded as ‘qualifying scale-ups’ will need to demonstrate:</p>
<ul>
<li>an annual average revenue or employment growth rate over a three-year period greater than 20%; and</li>
<li>a minimum of 10 employees at the start of the three-year period.</li>
</ul>
<p>Individuals will require a ‘high skill’ job offer and will need to be paid a minimum salary of £33,000 and meet the English language requirement.</p>
<p>Applicants will be entitled to a fast-track visa if they can meet the above requirements.</p>
<p>They will also benefit from greater flexibility to work in the UK because they will be able to move between different employers, and will also be eligible to apply for settlement in the UK after five years (subject to meeting specific requirements).</p>
<p><em><strong>Please note :</strong></em> It has not yet been confirmed whether dependents can join the main applicant on this route. However, similar visas do permit this.</p>
<p><strong>Revised Innovator Route:</strong></p>
<p>The government announced plans to revitalise this route with the aim of creating jobs for UK workers and boosting growth.</p>
<p>Under the revised route, applicants will no longer need to demonstrate they have at least £50,000 investment funds providing the endorsing body is content that there are enough finances to build the business. Applicants will however, need to demonstrate that their business venture has a high potential to grow and add value to the UK.</p>

	<p>Director of Clearview Relocation Immigration, Eldee Greyling shares compelling stories into his line of work. <p>South African-born, Eldee moved to the United Kingdom (UK) in 2001 with hopes of securing a better future for himself. Having to migrate and move away from familiar surroundings can be daunting and the endless paperwork – frustrating, Eldee described the experience and process as extensive, complicated, and sometimes demanding and then laughs as he says “and then by chance I ended up working in immigration!”</p>
<p>After years of working in almost every job in the global mobility industry, Eldee started working in immigration back in 2016. In 2020 he met with Clearview Relocation Group founders, Simon Bell and George Holmes, they joined forces and founded Clearview Immigration.</p>
<p>Clearview Immigration now provides a full array of visa and work permit services which cover both the Corporate and Private sectors on an inbound and outbound/global basis. Working alongside the other divisions of the Clearview Group their clients now have access to a full range of Global Relocation Services offering specialism in Relocation, Removals Management (and a soon to be announced new venture) all under one roof.</p>
<p>The founding principles of the company were simple – to provide their clients with a relocation friendly service that puts the people first – something that is replicated across the group and makes Clearview Relocation one of the standout choices when considering which relocation company to use.</p>
<p>Eldee clearly remembers his own migration journey and makes it his mission to go the extra mile for his clients so that they can benefit from a different approach.</p>

<p>While meticulously striking the balance between the daunting immigration laws and being sensitive to the fact that he is working with people, he guides his clients through the process in an approachable, friendly and organized manner as his predominant trait in a business is the love of making a difference. He recalls heartwarming stories that make it all worthwhile, a couple where the wife was living in the United States and the husband in Glasgow, Scotland as circumstances (immigration laws) would not allow them to live in the same place, they had lived in separate countries for two years and desperately wanted to be together, Eldee and his team worked tirelessly and creatively to ensure that they could be together.</p>
<p><em><strong>“It is great when everything works out well, at Clearview Immigration we always ensure that a positive outcome is achieved wherever possible!”</strong></em></p>
<p>Looking ahead, Eldee very much hopes that we can return to some form of normality and is looking forward to the return of pre-pandemic business levels. He very much believes that the UK has not yet felt the true impact of Brexit and that there will be a lot to take care of when businesses are able to get back on track.</p>

	<p><strong>The Graduate Route</strong></p>
<p>The Government's introduction of the Graduate Route represents a long-anticipated change and will allow international students to stay in the UK, once they have successfully completed their studies.</p>
<p>This new route will be <strong>live to all graduate applications on 1 July 2021.</strong></p>
<p>Businesses should be aware of this new immigration route as Graduate visa holders could be an important pool of labour for employers without the need for a sponsor licence.</p>
<p>For many UK businesses, this post-Brexit incentive represents a welcome boost to an economy already severely impacted by the pandemic. It sets out the Government’s ambition to recruit and retain the very best and brightest pool of international talent, by increasing the number of international higher education students in the UK to 600,000 by 2030.</p>
<p><strong>What to Consider:</strong></p>
<ul>
<li><strong>All International students who have completed a Bachelor or Masters degree</strong> will be allowed to stay in the UK for further two years. This also includes professional qualification degrees, such as LPC or PGCE. PhD graduates can stay for three years.</li>
<li><strong>Applicants must have a valid Student (or Tier 4) visa at the time of application.</strong></li>
<li><strong>No sponsor is needed and applicants do not need a job offer to apply.</strong> They will be able to work in any profession, at any level (apart from restrictions for those working as a doctor, dentist and as a sportsperson).</li>
<li><strong>There is no minimum salary requirement on this route</strong>, so applicants can work freely and flexibility under this route. Applicants can also be self-employed.</li>
<li><strong>The Graduate route does not lead to settlement.</strong> Applicants must switch to other categories before their visa expiry to remain in the UK.</li>
<li><strong>Students must be living in the UK with a current student visa.</strong> If the course duration is less than 12 months, all of their time must have been spent in the UK. Students studying a course of more than 12 months duration must have been granted permission to stay for at least 12 months on the Student/Tier 4 route and must have spent that time studying in the UK. There are limited exceptions for absences due to Covid-19.</li>
</ul>
<p><strong>Skilled Worker Routes</strong></p>
<p>The introduction of a <strong>general minimum salary requirement</strong>, means sponsors must comply with paying Skilled Workers a minimum rate of £10.10 per hour. This equates to the £20,480 minimum floor for a 39-hour week. This overall minimum salary requirement is intended to safeguard workers from exploitation, whilst reducing any potential abuse of the sponsorship system.</p>
<p><strong>New Entrants</strong></p>
<p>International students who have completed two years on the Graduate route will now be treated as ‘New Entrants’ under the Skilled Worker Route. Workers can be sponsored under the new entrant route for a maximum of 4 years. The 4 years includes time spent in any Tier 2 route or as a Skilled Worker, whether or not that permission was for a continuous period.</p>
<p><strong>Updates to EU Settlement Scheme (EUSS)</strong></p>
<p>The Immigration Rules regarding the <a href="https://www.gov.uk/settled-status-eu-citizens-families/what-settled-and-presettled-status-means" target="_blank" rel="noopener">EU Settlement Scheme</a> have recently come into effect from 6 April 2021.</p>
<p>There is now less than three months to go until the deadline for European Union (EU) citizens living in the United Kingdom to apply for the EU Settlement Scheme,</p>
<p><strong>Recent Amendments:</strong></p>
<ul>
<li>Allow the Home Office right to refuse applications where there are issues with the applicant’s conduct. For example, a criminal conviction committed from 1 January 2021.</li>
<li>Individuals applying under the EUSS as the dependent parent of an EU or Swiss citizen (or their spouse/civil partner) will now have to actively submit evidence of their financial dependency – this will no longer be assumed. This change will only apply to applicants who did not enter the UK prior to the end of the transition period and who apply after 30 June 2021.</li>
<li>Applicants are now able to use other forms of ID in cases where the required identity documents are unavailable due to reasons beyond the applicant’s control. This is a welcome development, acknowledging the vulnerability of some applicants whilst ensuring that the scheme continues to be accessible.</li>

<p>Changes to UK Immigration Rules will now make it easier for overseas health and care staff to be recruited to the UK. Now a year since COVID hit, this is seen as good news, not least for the NHS. The immigration system has previously been criticised for excluding care workers from the list of occupations, despite their <a href="https://www.gov.uk/government/news/rule-changes-to-make-it-easier-to-recruit-health-and-care-staff" target="_blank" rel="noopener">critical support role during the global pandemic</a>.</p>

	<p><strong>What Occupations Have Been Recommended to be Removed from the Shortage Occupation List?</strong></p>
<ul>
<li>2433 Quantity surveyors</li>
<li>5434 Chefs (removed 6 April 2021)</li>
</ul>
<p>The law can be quirky. This includes an amendment to the requirements for ‘welding’ as a shortage occupation. Note, only ‘high integrity’ pipe welders qualify, where the job requires 3 or more years of experience, and experience must not have been gained ‘illegally’.</p>
<p>Skilled chefs removed from the Shortage Occupation List continue to qualify for sponsorship. More details about the <a href="https://www.gov.uk/skilled-worker-visa" target="_blank" rel="noopener">skilled workers visa</a> can be found here.</p>
<p><strong>What Happens Next?</strong></p>
<p>A major review should take place every 3 years. All occupations will effectively be reconsidered and all eligible occupations invited to submit evidence to qualify.</p>
